Welcome to PulseCX. These Terms of Service ("Terms") govern your access to and use of the review intelligence platform, software, and services provided by Mahati Innovations Private Limited ("we," "our," or "us").

1. Acceptance of Terms

By registering for an account, subscribing to a plan, or accessing the PulseCX platform, you agree to be bound by these Terms and our Privacy Policy. If you are entering into these Terms on behalf of a company or legal entity, you represent that you have the authority to bind such entity.

2. Description of Services & Fees

PulseCX is a unified B2B software platform designed to pull, organize, notify, and assist in replying to customer reviews across connected third-party platforms.

• Setup Fee: A one-time non-refundable platform license and setup fee of ₹50,000 (exclusive of 18% GST) is required to initialize your multi-location instance.
• Subscriptions: Standard subscription fees (such as the Growth Plan at ₹10,000/month, exclusive of GST) are billed in advance on a recurring monthly, quarterly, or annual basis depending on your selection.
• Invoicing: Tax invoices are generated automatically with GST details provided by the customer during signup. All payments are processed securely via Razorpay.

3. Customer Responsibilities and Platform Conduct

You agree to use the platform in compliance with all applicable laws, including Indian IT laws and third-party developer policies (Google Business Profile, Facebook API, Yelp Terms). You are solely responsible for:

• Maintaining the confidentiality of account login credentials.
• Configuring auto-reply rules and notifications responsibly. We are not liable for responses generated or published by AI configurations or rule triggers.
• Ensuring that user consent is obtained for any customer contact triggered via WhatsApp/Telegram alert alerts.

4. Limitation of Liability and Warranties

The services are provided on an "as-is" and "as available" basis. To the maximum extent permitted by law, Mahati Innovations Private Limited shall not be liable for any indirect, incidental, special, or consequential damages, including loss of profits, data, or reputation resulting from your use of the platform.

5. Governing Law and Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of India. Any disputes arising out of or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts located in Bangalore, Karnataka, India.

6. Termination

We reserve the right to suspend or terminate your account if you violate these Terms, fail to pay subscription fees, or use the platform in a manner that threatens platform security or breaches API guidelines.
